What is the City asking residents to comment on?

The City's Development Management Scheme (DMS) contains rules that control how a property may be developed. These include rules about maximum building height, the number of parking bays required, and the number and spacing of vehicle entrances.

A permanent departure means the applicant is asking the City for permission not to comply fully with one of those normal development rules. For Erf 9702, the applicant is asking for three departures:

Building height

Normal rule: The maximum height for the affected buildings is 12.0 m.

What is being asked for: Permission for the new four-storey buildings next to Kruis Road to reach 12.34 m.

Difference: 34 cm higher than the normal maximum.

Parking

Normal rule: The City's parking requirements result in 146 parking bays being required for the proposed development.

What is being asked for: Permission to provide only 127 parking bays.

Difference: 19 fewer parking bays than normally required.

Vehicle entrances / carriageway crossings

What does this mean? A carriageway crossing is a vehicle entrance or driveway crossing from the street into the property.

Normal rule: No more than two carriageway crossings are permitted, and the relevant crossings must be at least 12 m apart.

What is being asked for: Permission for more than two crossings, with some of them only 9.5 m, 9.4 m and 2.5 m apart instead of 12 m.

Why is this not a rezoning application?

Erf 9702 is currently zoned Local Business 2 (LB2). According to the applicant's current planning motivation, the proposed dwelling houses and flats are already permitted under LB2. The current application therefore does not ask to change the zoning; it asks only for the three departures explained above.

The plan includes four-storey buildings about 12.34 m high instead of the 12 m limit.

8. VEHICLE ENTRANCES AND SAFETY

The application asks for more vehicle crossings and reduced spacing. It also refers to 9 crossings but describes only 5, with some proposed spacings as little as 2.5 m instead of 12 m.
